Does a Power of Attorney remain valid after the Principal passes away?
No. Under Section 201 of the Contract Act 1872, the Power of Attorney automatically and instantly terminates upon the death of the Principal. Any property transaction executed on the basis of a deceased person’s POA is void ab initio.
